These terms apply where coaching, workplace strategy support, mentoring, training, application support or related services are funded, in whole or in part, through an Access to Work grant.

They should be read alongside our main Terms & Conditions, Privacy Policy, Safeguarding Policy, Complaints Policy and any written agreement, proposal or booking confirmation issued to you.

1. About Access to Work funded support

Access to Work is a UK government scheme that may provide grant funding towards practical support to help people with a disability, health condition or mental health condition get or stay in work. Flourish with Neurodiversity is an independent provider.

We are not part of Access to Work, the Department for Work and Pensions, or any government body. Access to Work decisions, award amounts, eligibility criteria, payment processes and funding conditions are outside our control.

2. No guarantee of grant approval

We may provide information, quotations, service descriptions, supporting documents or application support to help you make an Access to Work application, renewal or related request.

However, we cannot guarantee that Access to Work will:

approve your application;

approve the full amount requested;

fund the type of support requested;

fund the full number of sessions requested;

fund coaching or workplace support specifically;

backdate funding;

process your application within a particular timeframe;

pay invoices within a particular timeframe;

continue funding for the full period expected.

Any decision about eligibility, award amount, payment process or funding conditions sits with Access to Work.

3. Limited support with Access to Work applications

We may offer a limited number of slots to support clients with completing or preparing an Access to Work application, renewal or related paperwork. This support may include helping you think through your workplace needs, coaching-related support requirements, practical barriers, access needs, or information that may be relevant to your application.

Application support is offered subject to availability. We may not always be able to provide this support, and availability may vary depending on our capacity, existing client commitments and the level of support required. This support is not a guarantee of any specific result.

We cannot guarantee that Access to Work will approve your application, award funding, approve a particular type of support, approve a specific number of sessions, or make a decision within a particular timeframe.

Access to Work decisions are made independently by the relevant government department. You remain responsible for checking the accuracy of your application, submitting it on time, providing any requested evidence, and responding to any follow-up questions from Access to Work.

4. Responsibility for funding and payment

Unless we agree otherwise in writing, you remain responsible for ensuring that funding is available before booking or attending sessions. Where Access to Work funding is not available, delayed, refused, reduced, suspended, cancelled or changed, you are responsible for paying any outstanding invoices for services already delivered or booked in accordance with our cancellation terms.

This applies whether you are:

self-employed;

employed and managing your own Access to Work award;

an employer booking support for an employee;

a third party arranging support on behalf of someone else;

Access to Work funding is between you, your employer where relevant, and Access to Work. It does not remove your responsibility to ensure our fees are paid.

5. Award letters and evidence of funding

Before Access to Work funded sessions begin, we may ask you to provide a copy of your Access to Work award letter or other written confirmation of funding.

This helps us check:

the type of support approved;

the approved hourly or session rate;

the number of hours or sessions funded;

the grant period;

invoicing requirements;

any conditions attached to the award.

We will store award letters and related documents securely and only for as long as needed for service delivery, invoicing, audit, legal, accounting or safeguarding purposes. These documents will be handled in line with our Privacy Policy.

6. Delays in Access to Work payment

Access to Work payments may be delayed for reasons outside our control, including processing times, missing information, changes to your award, claim queries or administrative issues.

If payment is delayed, we may:

continue sessions while payment is pending, at our discretion;

pause further sessions until payment is received;

ask you to settle overdue invoices directly;

ask for updated evidence from Access to Work;

change payment arrangements for future sessions;

We will aim to communicate clearly with you about any payment issues. However, delayed payment by Access to Work does not remove your responsibility to pay for services already provided.

7. If Access to Work refuses, reduces or changes funding

If Access to Work refuses, reduces, withdraws, suspends or changes your funding, you must tell us as soon as reasonably possible.

Where funding changes, we may need to review your support plan. This may include:

reducing the number of sessions;

changing the frequency of sessions;

changing the type of support provided;

pausing sessions until funding is clarified;

agreeing a self-funded arrangement;

ending the support arrangement. Any sessions already delivered remain payable.

8. Sessions used beyond your grant

You are responsible for monitoring how much of your Access to Work grant has been used. If you book or attend sessions beyond the amount, period, type or rate approved by Access to Work, those sessions may not be covered by your grant. In that situation, you will be responsible for paying our fees directly unless we have agreed something different in writing.

We recommend that you keep your own record of:

sessions booked;

sessions attended;

sessions cancelled;

invoices issued;

invoices submitted to Access to Work;

payments received;

remaining funded hours or sessions;

9. Invoices and audit trail

We will provide invoices or receipts for Access to Work funded support where required.

Invoices may include details such as:

client name;

service provided;

date of session;

duration of session;

hourly or session rate;

invoice number;

provider details;

payment details;

any information reasonably required by Access to Work;

You are responsible for checking that any invoice requirements from Access to Work are shared with us before sessions begin.

We keep appropriate records of sessions, invoices and payments for accounting, audit and compliance purposes. These records may be used to respond to reasonable queries from you, your employer, your authorised representative, Access to Work, our accountant or relevant legal/regulatory bodies.

10. Cancellation and non-attendance

Access to Work funded sessions are subject to our standard cancellation and non- attendance terms unless we agree otherwise in writing.

If you cancel late, do not attend, or are unavailable for a booked session, the session may still be chargeable.

Access to Work may not agree to fund missed, late-cancelled or unused sessions. If Access to Work does not pay for a missed or cancelled session that is chargeable under our terms, you will be responsible for paying the invoice directly.

Please give as much notice as possible if you need to rearrange a session.

11. Client responsibilities

You agree to:

provide accurate information about your Access to Work award;

tell us promptly if your funding changes;

check that the support you book is covered by your award;

keep track of your remaining funded hours or sessions;

submit invoices or claims to Access to Work promptly where required;

respond to Access to Work queries in a timely way;

pay any amounts not covered by Access to Work;

tell us about any relevant deadlines, conditions or invoice requirements linked to your award;

12. Employer or third-party funded arrangements

Where an employer, organisation or third party is responsible for payment, this must be confirmed in writing before support begins.

If an employer or third party fails to pay, or if Access to Work does not reimburse them, we may pause or end further support until payment responsibilities are clarified.

Where an employer is involved, you are responsible for ensuring that everyone involved understands who is responsible for payment and what Access to Work has agreed to fund.

13. Changes to these terms

We may update these Access to Work Funded Coaching Terms from time to time. The version published on our website at the time of booking will usually apply unless we agree otherwise in writing.
